If properly configured, there is no way magicJack can tell you are using an ATA.

Don't be so sure. The Mj softphone interacts with many windoze apps. Resgistry for one so don't miss inform people by stating that there's no way mj can tell if you're using an ATA.

When was the last time you traced this?
I traced it about 30 seconds before posting.

When does it contact the provisioning server? When I watch it using Wireshark, the very first thing it does is contact the proxy using an IP address.

It has nothing to do about users being able to change their host files, it is about redundancy where magicJack can change the DNS server to point to an operating proxy.

You cannot - magicJack does not publish this information ahead of time. Nor do they making finding version numbers easy.
