Mike: I've done most of what you are going to ask, Here is a rundown of what I've already done
Mike: This is what I have tried so far 1. update magic jack 2. try a different phone 3. try a different usb conn 4. try a different computer I can receive calls on the phone, and can dial from computer

Bradley: Is your magicjack plugged in on that computer, Mike?
Mike: yes, it is back to it's original setup

Mike: just under the sign they have that magic jack is a non returnable item and must be warrantied by the manufacturer

they kept saying they couldn't find my account, then they ask where I bought it. At this I am through fighting with magic jack. for the 4 months I've been using this thing it cost $30 month with about 30% uptime, I can do better than that with 2 tin cans and a string...

new math is right, the cost of the MJ, plus I put it on an old computer for sound quality. so what I have spent on this thing divided by 4 months = 30 month.
and MJ and Radio Shack both are probably having so many returns is why they are dumping it on each other, now MJ has too many costomers to just cut and run, so they are trying to cut there losses.

If you're motivated, you can file a complaint with the BBB. I think MJ's non-support policies (for those who purchase retail) is a legitimate complaint. I can understand that MJ would expect the retailer to handle DoA (dead on arrival) complaints. Perhaps for 30 days. That's standard. If you buy a cordless drill at Home Depot, and it breaks after 30 days, they tell you to contact the manufacturer.
I think the game MJ is playing is that the Terms of Service say MJ does not warranty the service or device beyond the 30-day trial. They'll point to that as justification. But, MJ goes beyond the Terms of Service for product purchased directly from them. And, they don't disclose that buying retail is treated inferior.
That's something else you could do. Write the CEO of Radio Shack and express your concern for how you were basically told by MagicJack that people shouldn't buy from retailers. (That it's deceptive for MagicJack to sell its product through Radio Shack, and then put the customer in this position that the customer should have known Radio Shack is inferior.).
