Voicemail Problems!!!! Possible Lawsuit Considerations
I have had a multitude of problems for the last 3 weeks with voicemail, and my numerous complaints & maybe solutions via customer support have not resolved the problem.
I have used MJ for my business & now anyone that calls gets the generic outgoing message w/number and not my pre-recorded message with business name, etc.
I am considering filing a complaint with the Federal Trade Commission, and if I get even more angry (depends on the heat), I might engage in a class action lawsuit, as I think there are several others out there that are having a multitude of problems, and would like to join this lawsuit.

Before you go off the deep end you might consider reviewing the magicJack Terms of Service. Here's an extract
"...magicJack reserves the right to modify or discontinue the magicJack device and Software, temporarily or permanently, with or without notice to you. We will not be liable to you or anyone else in the event that we exercise our right to modify or discontinue the magicJack device or Software."
I'm not a lawyer but this makes me wonder on what basis you feel you have a case.

Well, such a disclaimer does not mean much and depending on state law he could have a case. But I do not believe anybody would take this case on contingency and it could be very expensive to pursue this.
By the way, with the high degree of unreliability MJ is known for I would not recommend it as a primary business phone.

I agree that MJ doesn't advertise the service accurately. It's not as easy or reliable as portrayed. But, the old adage "you get what you pay for" still applies. Anyone who thinks they're going to get landline-quality services (which cost about $50 a month?) for $1.67 is partly to blame for their own disappointment.
Especially if they make this mistake with their business.
People need to realize that MJ plays upon the greed of potential customers. Some fall for it more strongly than others.
Chalk it up to a lesson in life. Wasting time on a lawsuit (over $1.67) is just asking for another lesson.

Fault Lies with You...
Your case wouldn't last more than an hour in a court man... The fault lies in your buisness plan and any educated jerk will tell you that you POORLY chose the cheapest and least dependable means of communication you could possibly muster. I mean seriously if you have half a brain you would have noticed that WALKIE TALKIES are a more dependable means of communication especially since they always work.
And Im not trying to be an adversary of making companies offer what they promise but seriously. LOOK at what you are talking about doing.
1. MagicJack is basically free... I mean cmon where else can you get phone serviec for 29 dollars with free caller id, voice mail, voice mail forwarding, and free 411? NO WHERE
2. You want to sue this company knowing they make basically nothing on thier services, and to be honest with you I think they are doing pretty well with the service considering what menial re-embursement they are receiving.
3. You may consider the thousands of people out there out of work who do use magicjack as his or her ONLY means of communication. You sue a company like this and you dont just screw those in need you screw everyone.
Either way pompus fools like you go about your daily lives thinking about the big picture "YOU" and dont consider others when you make BAD DECISIONS ... SERIOUSLY you own a buisiness ... get a real phone like the rest of em... Quit blaming your frugal inhabitions on other people...
Get on with your life and let us get on with ours ... seriously your thread is a waste of time grow a set and deal with your mistakes.

What cracks me up is that he didn't even bother to do a Google search about MagicJack. That would have turned up plenty of criticisms about its reliability. Enough that he would have known it isn't suitable for mission-critical use (resumes, customer contacts, etc.).xXBringItXx wrote:2. You'd think anyone (especially a business) considering changing phone services would do some basic research. Especially when the proposed replacement is $1.67 per month (after cost of USB device).

I did not base my purchase on internet research either, because I quickly found out that half of the "reviews" were pure propaganda posted by paid oponents or proponents of the service. However, I extensively tested the device in a small office where it is being used as a secondary line. I have not seen any of the infomercial before the purchase( I would not have bought it if I did). It does not work for me quite as perfect as in the office-might be the difference between Comcast business and ATT DSL or in lesser extend XP vs. Vista but I am still basically a happy customer- you cannot beat those 1.67/month!What cracks me up is that he didn't even bother to do a Google search about MagicJack
But i think that a lawsuit might be beneficial not only for the customers, but also for Dan and the long term viability of the project. It could move it away from something what often looks like a sleazy Ponzi scheme toward a reputable business.
Among many things, I do not understand why he does not make the voice mail better and more reliable. With the upcomming Google voice and a growing number of VOIP providers offering free incoming calls he may loose the entire incoming call business .
You might be right if Dan's a rational person. Great point! The termination fees are key to the long term viability of MJ. Once the hardware market has been exploited were will the revenue be derived from? Selling advertisements to display on the softphone is just not going to cut. Remember AltaVista and Net Zero with the free dialup service that placed a banner box for advertisements when you used the free internet service Both of these failed miserably with this business model and suspect MagicJack will do the same. Every MagicJack user will have a cheap $19.99 MagicBox that was made in China specifically configured for the MagicJack with just decent enough specs to support the USB dongle. Its just a matter time before a company offers such device to support a successful that has sold millions of units. A great example of this is the Apple iPod which since its introduction has spawned its own ecosystem of support products. Another example of this would be Skype. Just look on eBay for a Skype phone.
